Welcome to WarpDesk. Please read on to learn the rules and restrictions that govern your use of our website(s), products, services and applications. The Terms of Service is a binding contract between you and WarpDesk ("we" and "us"). Upon signing up for WarpDesk, we will ask you for a username, e-mail address, and password. You promise to provide us with an accurate and up-to-date e-mail address that belongs to you and can be used for support and recovery purposes. You will not share your WarpDesk username or password with anyone, and you must protect the security of your WarpDesk username and password. You're responsible for any activity with your account. You will comply with all laws that apply to you and your use of WarpDesk. If your use of WarpDesk is prohibited by applicable laws, then you aren't authorized to use WarpDesk. We can't and won't be responsible for you using WarpDesk in a way that breaks the law.
Intellectual Property
All content, trademarks, service marks, trade names, logos, and intellectual property rights on WarpDesk (including but not limited to software, text, graphics, images, and other materials) are owned by WarpDesk or its licensors and are protected by copyright, trademark, and other intellectual property laws. Your use of WarpDesk does not grant you any right or license to reproduce or otherwise use any WarpDesk or third-party trademarks, logos, content, or intellectual property.
Unacceptable Use
By agreeing to the Terms of Service, you hereby agree to comply with the following guidelines:
- You will not use WarpDesk on a Virtual Private Network (VPN), proxy, or a malicious IP address.
- You will not share your WarpDesk account credentials with anyone, including friends.
- You will not use WarpDesk for any unlawful purpose
- You will not decompile, reverse engineer, disassemble, or otherwise attempt to discern the source code or interface protocols of any software or other products or processes accessible through WarpDesk
- You will not remove or modify any proprietary markings or restrictive legends placed on WarpDesk
- You will not use WarpDesk, or any portion or component thereof in violation of any applicable law, in order to build a competitive product or service, or for any purpose not specifically permitted in the Terms of Service
- You will not cover, obscure, block, or in any way interfere with any safety features and/or security features on WarpDesk
- You will not circumvent, remove, alter, deactivate, degrade, or thwart any of the protections in WarpDesk;
- You will not take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our technical infrastructure
- You will not interfere with or attempt to interrupt the proper operation of WarpDesk through the use of any virus, device, information collection or transmission mechanism, software or routine, or access or attempt to gain access to any data, files, or passwords related to WarpDesk through hacking, password or data mining, or any other means.
Although we are not obligated to monitor access to or use of WarpDesk, we have the right to do so to ensure compliance with the Terms of Service, and to comply with applicable law or other legal requirements. We have the right to investigate violations of the Terms of Service or conduct that affects WarpDesk. We may also consult and cooperate with law enforcement authorities to prosecute Users who violate the law.
Eligibility
You must be at least 13 years of age to use WarpDesk. By agreeing to these Terms, you represent and warrant that you are at least 13 years old. If you are under 18 years of age (or the age of legal majority in your jurisdiction), you may only use WarpDesk with the consent and supervision of your parent or legal guardian.
Moderation
We reserve the right, in our sole discretion, to restrict, suspend, or terminate the Terms of Service and your access to all or any part of Warpdesk, at any time and with or without reason without prior notice or liability. We reserve the right to change, suspend, or discontinue all or any part of WarpDesk at any time without prior notice or liability.
Liability and Warranties
WARPDESK IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. TO THE
FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL
WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT
SHALL WARPDESK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES,
WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE,
GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS
TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY
CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT
OBTAINED FROM THE SERVICE; AND (D) UNAUTHORIZED ACCESS, USE OR
ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR
AGGREGATE LIABILITY EXCEED THE GREATER OF TWENTY FIVE U.S. DOLLARS
(U.S. $25.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX
MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold harmless WarpDesk and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
Privacy Policy
When you sign up or log in, WarpDesk uses Google reCAPTCHA and other security checks to help prevent abuse. This may involve processing your IP address and sending your reCAPTCHA response token and IP address to Google for verification. We also use IP addresses for VPN/proxy detection and rate limiting. We do not store IP addresses as part of your account profile. When you create an account, we collect your email address, username, and password. We use your email address to create and secure your account, to validate that the address appears legitimate, and to contact you about account-related support issues. If sign-up fails its security checks, the sign-up data is not stored. When connecting a machine to your WarpDesk account, the following data is stored:
- A hardware hash derived from various components installed in your computer
- The operating system of your machine.
Machine data is stored for however long the machine is attached to a WarpDesk account. Once a machine is disconnected, the data is deleted except if the machine is hardware banned then only the hardware identifier is stored to enforce moderation; all other data is erased. Finally, upon logging into your WarpDesk account in your web browser, a small text file (called a "cookie") gets stored in your web browser for authentication. This cookie either lasts 27 days, or 8 hours, depending on whether the "Remember me" checkbox was ticked during login (27 days if checked, 8 hours if not checked). Temporary cookies may also be stored for effective rate limiting, which do not contain any personal information and lasts 12 hours. To delete these cookies, use your web browser's settings.
When connecting to another machine via WarpDesk, your computer's audio and video data may get routed through Cloudflare's infrastructure to help provide our service to you with lower latency. This audio and video data is not stored and is encrypted using Datagram Transport Layer Security ("DTLS") for privacy.
Finally, when paying to use WarpDesk, credit and debit card payments are processed by our payment processor Polar.
